Certain dollar amounts in the United States Code applicable to bankruptcy cases are being adjusted to reflect the change in the Consumer Price Index for All Urban Consumers for the most recent 3-year period ending immediately before January 1, 2025. These adjusted dollar amounts become effective on April 1, 2025. The New (Adjusted) Dollar Amounts reflect a 13.2004 percent increase, rounded to the nearest $25. The affected code sections, the current dollar amounts, and the new dollar amounts as of April 1, 2025, can be accessed HERE.
In addition to the changes to the Bankruptcy Code related to the increasing dollar amounts, there will be changes to the following Official Forms:
- Official Form 106C, Schedule C: The Property You Claim as Exempt
- Official Form 107, Statement of Financial Affairs for Individuals Filing for Bankruptcy
- Official Form 122A-2, Chapter 7 Means Test Calculation
- Official Form 122C-2, Chapter 13 Calculation of Your Disposable Income;
- Official Form 201, Voluntary Petition for Non-Individuals Filing for Bankruptcy;
- Official Form 207, Statement of Financial Affairs for Non-Individuals Filing for Bankruptcy
- Official Form 410, Proof of Claim
- Director’s Form 2000, Required Lists, Schedules, Statements, and Fees
- Director’s Form 2830, Chapter 13 Debtor’s Certifications Regarding Domestic Support Obligations and Section 522(q)
NOTE: There is no dollar amount currently set forth in 11 U.S.C. § 1182(1). Most recently, the Bankruptcy Threshold Adjustment and Technical Corrections Act (BTATCA) (Pub. L. 117-151, 136 Stat. 1298) added a dollar amount to that section, but the BTATCA provision that included the dollar amount sunset on June 21, 2024.
